What you are perceiving and appreciating (apprehending) is the pendular, up and down emotion circling on white authority and there is no issue with presumptive white authority or social position with or without education but the coffee should be hot, the black rubber wheels pumped up and the galley full of food and the toast is not burned. There should be enough paper for the computer printer and enough basic income for the citizen so that the economy can function. None of the above is debatable and if in order, white is good in presumptive appointed authority; why not? The point of education is functionality; not assimilation when the dishwasher machine needs a consumer in Nevada...or in the Lakota nations or Missouri. Egypt is in Africa and its ancient civilization was certainly as black and multi-complexioned as the people in North Africa are today. Are they still compensating you for your White Amerindian Americano beauty with insufficient education? Juicy fruit is going to move you but At Western, articles by Sunkel and Wallerstein pointed out the structural nature of the world political system and also of the capitalist world economy. The political system may be based on tiers of influence and hegemony as we can see quite clearly yet as time moved on from our current juncture's valuation date of May 25th, 1977, now, it is evident that economic strength is influence, a strong population and it is also hegemony and systemic leadership. This is essentially agreement with other older economists who predated the founding of America but not China, Japan or Europe. The economy as Wallerstein points out may be a vacuum of rules involving the Smith/Keynes efficency with the central purpose being consumption in pure capitalism as a closed system;a simple system of buyers and sellers globally as one system offering goods at the lowest price yet as the established system it cannot entail a secondary system running counter to it that proffers as a socialist communist system the offering of allegiance to a belief in human equality and social programs that confirm this belief but with more expensive and some times inferior, wasteful manufactured goods. Both systems of influence , socialist communist and American capitalist, were dedicated officially to human equality as renditions of the one true global capitalist system (pure capitalism) and only one has had a Black leader or two while the system in America with Black leaders is insufficient as to ensuring the value of human life regardless of complexion. The two renditions competed around the world for influence and allegiance bit there is only one true global capitalist system. Comparatively speaking Socialist Communism was more akin to Pure capitalism in preserving and maintaining the consumer / citizen who was referred to the worker primarily. This pure capitalism, however, involves internal national efficiencies and global efficiencies. The global efficiencies demand the free movement of goods with the maintenance of home land security and national dignity; sovereignty also. The internal national efficiencies involve the most cheaply made goods and no waste of human life. But, what national dignity can you have if your people die off in the shift towards an automated robotic labor economy and away from the era of human muscle labor? As such, socialism was confused only on the point of the free movement of goods with a protectionism that blocked coca cola and Camel cigarettes as if they were propagandist while the Lada was the superior, more cheaply made automotive product with its technology being swarmed by Americans, Europeans and Asians in the guise of the Audi/Volkswagen. Socialist Communism was right as to the maintenance of the citizen /consumer/worker with what are now also UDHR policies so that the citizen as the key symbol of national dignity and as a consumer was enabled as a buyer and seller of machine made goods, made efficiently free of the cost of human labor in the purest form of aggressive capitalism. Capitalism in America,the American rendition (now in respite) suffered from an erroneous notion of aggressiveness and determined to argue that the citizen regardless of complexion is waste-able, disposable while the citizen is the most important engine or widget in domestic and international,truly aggressive, expansive and hegemonic growth capitalism. It is a false notion that American capitalism is aggressive yet fails to maintain the dignity and viability of the citizen. The strong, viable citizen is evidence of a strong and viable capitalism. The work of Marx, Lenin but also Mao Zedong in his book on Contradiction in the late 1930's is a perfect summation of what Contradiction you Apposite Amerindian late arrivals portend as Zedong confirms the understanding of Adam Smith, Keynes and the role of technology as affecting the role of human labor but not the value or the role of human life as set within the era of machine, robotic labor. As such the importance of maintaining the citizen in pure capitalism that is analogous to socialism is evident when people are the final end game to be won over as the domestic or international market you confused Anglo Latino people struggle to digest what you witness going on around that is really your emotional exam after all; all this time. Will it be the ramen, the sushi or the Ford truck on a Toyota platform or all three since we have basic income now and you feel good?

The man who was a pirate ship captain had children with a woman who was the daughter of Cabot; Cabot being an orphan like the pirate ship captain. The boy grew up and demanded that people listen to him when he spoke and he had a commanding voice except because of the Cabot dna, the only place he seems to have wanted to go was back to France to ask if he was accepted. Words like appreciation, honor, award, inheritance etc...greeting card words would drive him to jealousy and emotions that centred on competition. He bought a house quite young and should have planned to give it to his children as testator but seems to have worked it out that he would rather abandon the home and allow others to take it or squat in the home. When his children bought homes, he seems to have wanted to live in it with them only to have an authority game with them or power game as to ask if they would ever try to command him to come or go etc and to also place himself in a position to hope to inherit from them but not with any discussion. His wife was a court jester who sought attention and spent a lot of her energy in 'make believe' again in society like in the court with queen watching but not for work that honors but for rude, jester behaviours that mock and tempt authority. The man who chose to seek to inherit from his children vs. being the testator was unable to help himself it seems in seeking acceptance as if Cabot's dna took exploring North America's waste land regions as eternal damnation so far away from the pastry shops of Paris or Toulousse and while he was part ship captain, he was also that jester and that Cabot desperately seeking acceptance so that almost anyone could interrupt his boundaries of self respect and tell him what to do. It was quite unusual to see a man who raised 9 BLACK children and demanded that school teachers respect his wishes for their placement in the advanced class, some how turn around and help the people who were in the bottom of the school system and who were jealous of his Black children's work as graduate professionals since any band wagon or mob emotion for acceptance is what he would follow as part of Cabot's dna and the jester also was essentially indentured servant dna who believed they were owed something ancestrally as entitled to them biblically and they seem to have decided to hold officialdom ransom was the pirate's dna would understand how to do it until the debt is paid to the death. Yet the people demanding that he ignore his boundaries of self respect were younger than him and anxious about social authority and acceptance but in the end, so was he as a father as he also had no formal education or if he did, he considered his children's education as more than what he got, many years more than what he got simply because he refused to go after 9 years old and this education was a threat to his pea brain 9 year old emotions as contained in a 5'10 80 year old body and the people begging him to hurt his children were much younger and all they did is laugh at him when he made a deal to sell his son's stuff to people who are probably dead and only emoting this concept from a building where they were imprisoned for life for stealing the possessions of other graduates who athletes of the year and university graduates; imprisoned for life as it is the penalty for mischief involving property; any property that might be intellectual property or business property that some may say they reserve the right without law to hold indefinitely. The real issue is the Court Jester's dna mocks authority and is rewarded some how and what if the mayor's dna is also court jester dna? His wife was part court jester and also Cabot where it mocked authority, resented anything called society but also wanted to hurt people who had any formal education since Cabot's dna seems to have said it had a right to inherit once as officialdom never gave him anything. Her real issue in seeking to be accepted once with the same Cabot dna as his was a resentment for complexions lighter than hers and her resentment was murderous; like a kamikaze hoping to kill any children or families that were targets for their complexion primarily but she would use any weakness or resentment to work division among that family to see her darker children inherit from her husband's lighter children while her children had the same opportunities to go to school as her husband's arguably lighter children but they were not as...beautiful but they also did not have her children's under cultural expectation of entitlement; an under culture of some kind in the West Indies and in spite of this under culture no one has to die or be targeted. She read only one book entitled ''Games My Mother Never Taught Me' and her darker people from Goat Island on the periphery of our world civilization wanted to see if she could make him do anything as triumph for darker people who see the world as favoring lighter skin and they imagine that the degrees suggesting inheritance or systemic acceptance are handed out to these arguably lighter people but everybody can see her husband's children were black; not light or straight nosed yet the Goat island people( some looking Asian with patois accents and resenting the father's ability to intimidate) wanted to see if they could turn the father who extolled education into an idiot..make him move like an idiot, like a robot and do anything like abandon two condos in a 'you are MI6 now' game so she drugged him and the lighter children and tried to use any weakness of character or sin or question about propriety she had against him, accusing him like '..Is it appropriate for you to be in a condo alone with my daughter and sit on a couch with her?' although he was so handsome and certain that he should be; be the leader of any situation or at least get the acceptance and authority for any 2 for 1 condo deal his son might have suggested they invest in. that while the son found the tenants, the father wanted to have the honor...steal the honor of his essays and law firm file work also with idiots who wanted to steal honor much like the father. Jeroboam stole a scepter once in his own expectation that he should be the king as a taller competitor for the throne already in Rehoboam's possession under a united Israel as son of Solomon but Jeroboam was a son of Mephibosheth who was the grandson of Saul and the son of Michal who seems to have been Ramesses dna. The only issue with all of this is not only the presumption to be the holder of an honor in other people's work as in stolen honor in the work the Lord's son has finished in faith but a continued drive right back to naught to ask who is the king and what is ownership if I want to just rip your ass? Michal was a sex operation and maybe she ripped some asses to finally understand what she is but unfortunately, with education it would have been obvious if she did not bleed at 12 every month. So, Jeroboam built buildings in a stolen, divided kingdom. This father only wants to say there should be no law; no civilization for his happiness in his kingdom and would want a a war to see the world end where he can be the leader or the general in a world that he wants; without rules of any kind and he will have the honor since in Jeroboam's world, although under a stolen throne, his honor would be to pass his buildings to his son. He would not steal from his son but would work with him for many generations. That is his glory although singed with some shame in the divisiveness and the theft. This man's glory would have to be shame in every rendition of human civilization but might have glory no where else but in a cave where the power of one neanderthal resists the power of another. If he was pure Cabot dna, then he might see the honor of being a testator like Jeroboam but the Pirate's dna, possibly Blackbeard, was part Dutch or Scottish cave dwelling neanderthal and he would hide the stolen loot quite often in a cave near Frenchman's Cove. Google Frenchman's Cove and understand the Pirates (plural) of the Caribbean. The father's deeper orphan minded, French indentured servant emotions and pirate determination that only sees human life as a casualty or collateral damage with his neanderthal underpinning and theories of emotional success in his paradigm or out look determined his practice. His glory is his shame; stolen honor, stolen degree statements, plagiarised essays and the effort to be his own son's heir of his son's little pattie shop, mechanic's shop or law firm in the year 2011. The father's glory is the father's shame. The son is always honored because he honored the father that fed him, clothed him in a four bed house in Westchester or a similar neighborhood and demanded that he do his school work and go to school. It looks like your son won the Caribana motion to honor you since the father is watching and helped Fukyerselfwenuhurtuson(that is all Farquerson is asking you to do when he sees what beach comber you are...and if you do it, then he is your master but I thought you were the chief of postal officers?) and now you want to steal the honor, the work and read the files in the Cave at Frenchman's Cove like your most primordial ancestry is willing you to do but you should have had enough authority to ask to be a duty counsel or Crown disclosure officer where you would read the allegations and then see the trial result on that file you thought was impossible but it was just really an exam question. European people don't want you to hurt people. You say you need to know if you are accepted and not rejected but how can you be accepted if you are hurting other people you call your competition in your harkening unto Europe for acknowledgement and to be seen? European people don't want you to hurt people. But you are part native Arawak and evidently part European or else your mind would not be turning to Europe. When Jesus said all the commandments are summed up in the command to love your neighbor as yourself, what does that mean to men who believe they should have a right to kill, steal and destroy and whose law and whose land is it when the neighbor is living on a subdivision that still is ancestral native land? There is a population that challenges, resists and resents the rules and attacks those involved in predicating the rules of peace as in the quiet laws of ownership of property and respect for human life. The territory is theirs. But, the law is from a received culture as emblemised in the US Constitution, the Magna Carta or the ten commandments. What if some of the people in this population are former Presidents, current U.S Presidents and future 3 time candidates? What if the evident social maladjustment of this population is manifested in the unpreparedness of a nation's democratically elected leader along with a racialised confirmation of their own sense of resentment and displacement vis a vis the written bodies of laws with a subtle but vicious complexionism featurism ( as in straighter hair but black or straighter nose but black) more so than the racialisation and this obfuscated by inclusive messages in the media that suggest the opposite yet there isn't one black school teacher in the entire country but there used to be millions of them before 9/11? What if for 3 and half years, the world witnesses nothing but a schooling of the elected leader and the abuse of the system by people who have always moved in the elected leader's slip stream. It is the Layer cake son. But, what if in 2001, someone says he will confirm again that he owns the territory and will ask what is the point of your laws if he can kill a soldier on the steps of a post office? Maybe you attack everybody in your Creole native community with any sense of officialdom or formality in education, destabilising them and sabotaging them to communicate your community's continued covert demand for compensation or maybe a treaty that other natives have while your Arawak community still has not received any such treaty. Maybe the end of this formal received Euro culture's officialdom on your land and your island is what you want so you can pick from any tree you see on what is now hotel property and take any villa, stand on any beach you see regardless of who owns it now since what is ownership? Isn't all the land to be owned in common? Who is the King if I can live in a home I do not own and put the owners under the floor? What is education if I can pretend to be the owner but I know I am not the owner? What is education when I can just pretend to be someone else with their ID or pretend to be a professional? What is a mortgage when your soul is not ready for that yet? Is your name Ray from the Ozark or Ray or Bubby Bare from Spanish Town? You look sort of Asian and you know how to challenge authority with a scallywag game, taking an American man's cigarette holder in his hotel room so he does not feel so authoritative when he comes to check his bank balance at the Bahamas branch. But the saboteur is a former employee of...a trainee of...but does not seem to believe he should have to respect ownership of property belonging to others. He might be the deputy chief of....and has a covert Arawak following with people who share his emotion regardless of complexion. Where did all of the West Indian graduates go; year after year, generation after generation? The graduate is a targeted symbol of that received culture but who put the demand on him to attend school except but that Arawak Native Black, Maroon, Asian looking, Hispanic or White looking native people and sometimes they have a Streatham accent? That relative sometimes follows the Creole Arawak mob in targeting his own graduate relative once the graduate status is achieved. But, isn't the graduate status family glory? You raised him or her. But, instead you resist, target and frustrate the graduate but he is your relative. People from Other communities that you envy watch and laugh as you hope to avoid culpability by emoting that you are just a child and how could you be guilty you say when the world took your Island in the Sun but your are guilty? You are a former chief of parking enforcement; a civil servant. Your intention is evident along with your compatriots. The greater community should react but when you have not reacted to defend your laws in his territory that is now really Crown governed, he says there is no Law so just go. He will stay and the received culture will go; n'est pas? When he kills a human being or his own son from his tribe or peoples on front of you and you don't react, he says what is the point of your laws? He has authority now? You should stop him to maintain your authority under your laws. But, human value and mutual safety also for the Creole is the point of the law. Many people who were victims of the original collision of cultures along with their descendants have digested law as theft since his territory was stolen under your laws. The questions have been asked before. We have the final answer as to all human value as the essence and purpose of the economy but this tension or the question has arisen before when much of human labor comes into immediate question technologically and full employment of the population is always the desired result vs. uncertainty and desperation but how is it that a population cannot just implement the basic income while instead it seems to challenge that solution in favour of full employment in a war on the brink of continued world civilization it self as seen in 1914 and 1939? Maybe you have been so abused by that received culture and civilization that it is hard to see you are worth it and not just refuse to be thrown away in the presence of your mechanised robotic machine labor as your replacement but your real purpose is the buying and the use of goods and products. E Pluribus Unum is the final answer. Basic income is the final answer but can imagery, if not alter policy and the evident final answer in Russia, Germany, America, Italy or Japan, can it impact negatively the minds and souls it seems only in America that are called upon to implement and give effect to policy thereby disabling the system and the people to benefit from the said non racialised policy in the false notion that you are approximating something Sophisticated, non former slave holding and non American? But, all societies had slaves for labor at some stage of their industrial development. The question is what hesitation is there? Presumedly, the logic of basic income is in the realm of European dna, African dna or Asian dna and it's genetic, historical memory. Basic income had its place in Egypt also after organised farming for the masses and the development of markets. The concept is predicated on the value of human life. Evidently, Natives do not resent the concept as an imposition from foreign powers. They have their own ten commandments that respect and value human life. But, there is a dna with an emotion that sometimes might be too well dressed these days and too skilled in a kitchen to be recognised in a discussion by anyone for it's continued emotional resistance of any rule of any kind; any rule or commandment since rules and commandments in themselves are foreign to this dna and also vehemently resented. This dna and it's resentment is not an issue when it is outside of the decision making process since the legislature was designed to maintain legislation based on the magna carta that values life. There is no argument there. As to the value of human life, the rules that uphold them, the decision making process and the final answer noted above, there is no argument or vehement resentment for what benefits us all. Policies that save life, build people and maintain life are the essence of our current and modern world economy that is nonetheless less dependent on people as industrial human labor whole remaining dependent on people as a commodity to fulfil consumption.

It may be a hedge against a true democracy. It certainly is control of quite a lot of what must transpire socio-economically to guarantee this agreement and many people have made agreements to own and run one Steak Restaurant for 80 years with sufficient support or to work as a bus driver safety officer. Click here: The absence of basic income in any country makes a people Refugees in their country! Some Canadians have it and others do not. There is no explanation. It causes internal displacement. It is generalised violence. It is evident disparity in the treatment of certain segments of the population for inexplicable reasons. A white, Part Eskimo or Black woman in one of the country receives basic income upwards of $50,000.00 per year and a white man in another part of the country does not receive this socio-economic benefit. However, he may receive $20,000.00 dollars as a Native reserve citizen off the coast of the Niagara Great Lakes region. He is suffering disparate treatment and it could be that his basic income will only amount to an additional $30,000.00 for a total of $50,000.00. Most our content that he would receive $70,000.00 in total. The means are not in doubt and nor is the necessity of this program and policy in an automated economy. It is an economically logical requirement but it is also a legal requirement. It should be as simple as your universal health care. It pays into your bank account on a bi weekly basis. The solution for the population suffering disparity in one part of the country is to address the disparity in an appropriate venue such as a Human Rights Tribunal. It is a known fact that people in Quebec have a basic income. Is it that people in Ontario do not receive basic income because they are not French speaking? That would be ludicrous but Ontarians do not actually have access to this socio-economic benefit. A class action law suit or a motion granting immediate relief from this disparity. Once it is brought to the government's attention they can amend the disparity as disparity in the provision of policy is not their policy mandate. As they intend to comply and rectify glaring errors, a motion is not necessary.

A sleeping bag and a warm spot in the basement near the TV or in the condo for ever and a bad word bag of rice is what these Muslim Asian Yellow people have come to North America to say about human value. It is dignity for a family to maintain its own dignity when the world around you has said they do not know what to do with your relative, daughter, son etc whether they are not a graduate or are a graduate of any kind. It is culture. In the Judeo Christian Islamic culture, we believe and confirm that God is God and there is no other. Even so, we are soo afraid that the Cheddar man's descendants arriving latest to Egyptian Romanic modernity may just focus on his emotional need to feel attention and authority as his only raison d'etre and forget to evolve socio-economically. Bentham was also a positivist holding the notion, as did Hobbes, that law was the command of the sovereign though Bentham would have been more inclined to say the "sovereign in Parliament". Bentham was wrong as laws will not have any value or utility to a state or its population unless they are just. Men do not serve the law and its purpose. The law must serve men and their need for justice in every result. A command that people should have no bread is a command contrary to the existence of the state or the sovereign. What is a state or a sovereign without a people? It is a non-entity. Utility was Bentham's theory yet misguided as utility or legal utility must be subservient to and mastered by justice and just results. Justice and her sisters (fairness and equity) master the Judge and determine a Judge's utility; not his or her ego or his or her self-will. We honor their decisions although they may be appeal-able on grounds of legal error or fact. Similarly, prosecutors do not seek to win cases to facilitate their ego. They are duty bound to serve justice on the public purse-public expense. No state nor its sovereign is served knowing there are those harshly treated or wrongfully convicted in cases where the complainant cannot identify the accused or where he or she says someone tried to touch them and failed because they moved away. There is no actus reus committed. Furthermore, when testimony is internally inconsistent due to coaching and prompting, this raises sufficient doubt and cannot be tolerated under the notion of a diluted standard of evidence simply because the alleged event is historical. How would you treat this evidence if the event allegedly occurred last week and not ten years ago? There is only one standard of proof to be applied to every criminal offence regardless of historicity. If this is not so, then complainants and accused are being treated differently in offences considered historical as opposed to contemporaneous with different standards of proof where the key issue is credibility (oath verse oath). What if it is a historical simple assault and I cannot provide the court a day, date or time as to when it occurred? The complainants can maintain diaries as in Shearing(2002) S.C.C.. They can also complain as in Khan(1990) S.C.C. at the moment and time the incident occurs. Why should the judicial system move goal posts in terms of evidence tests to make up for the lazy, shameful complicity of complainants who are trained and guided at school in safety class with peace officers and health educators what to do if the skating coach is a Cyrano-like(See Cyrano syndrome). There is balance in the system between the various stakeholders without a readjustment in the test of proof; a readjustment which should not take place in historical cases to make up for a complainant's shameful niggardliness. What if he, the complainant, says "...I think so" in video evidence concerning the accused's conduct or identity especially when the Crown has no other evidence to incriminate except hearsay statements. There is no opportunity for conviction because it is a sworn video statement. An unjust law or a misapplication of good law that terrorizes the populace therefore is without utility or has no usefulness. Bentham would have been familiar with Solomon's ruling concerning the child claimed by two mothers (1st Kings 3:16-28) and of Jesus' judgement with the woman caught in adultery(go and sin no more-(John 8: 1-11)). Akin to this, in practice, law in England was still very much the creature of rules as set down in the common law determined by judges through the doctrine of binding judicial precedent. Judges not only decided cases but they created law as required to realize justice amongst the parties in the circumstances of the case; not all judges but most notably Senior Justices such as the Lords in the House of Lords. Bentham like Dicey following him, believed that laws were technical rules that should be formulated scientifically and structured coherently in a systematic way. They were advocates of legal bureaucracy. Judicial discretion played less importance to law conceived of as an instrument and valued on the basis of its utility. But, this concept of law as an instrument was espoused at a time when England did not possess a clear separation of powers within its system of government. For instance, the House of Lords was a body which functioned in both the legislature and the judiciary. The Prime Minister was a member of both the executive and the legislative arm of government. This was not necessarily a bad thing since it might have helped foster understanding and co-operation amongst the different arms of government and prevent conflict and Grid-lock which sometimes occurs in the American government's decision making process. The judiciary, however, preceded parliament and had a more established tradition in the English political and legal history. It seems that this may have aided the judiciary to maintain its position as not only judges of fact and administrators but as judicial legislators. An example of this continued role of legislator is seen in the Judicature Acts 1873-75. Although it is an Act of Parliament, it made clear that whenever there is a conflict between law and equity, the laws of equity will prevail. This protected a Judge's use of discretion over the increasing use of statute and legislative instruments. It is within the Judicature Acts that one sees the conflict for prominence between less flexible rules in statutory instruments and judicial discretion being resolved. As with the writer of this paper, it is necessary to admit to a lack of extensive knowledge of the facts and historical subject matter that might relate to the 1873-75 acts. But the above summation seems appropriate and amounts to what Weber called the co-existence of formal-rational and substantive-rational laws. Substantive rational laws involve the making of decisions through the GLI application of ideologies, religion, or morals, says Weber. Equity is said to be governed by rules and maxims. But, these are quite flexible and arise sometimes from general moral precepts or, more specifically, biblical concepts. For example, the neighbor principle in Donoghue v. Stevenson [1932] HL, the cornerstone case for the Tort of Negligence, was developed when deciding how to achieve a just result between a plaintiff consumer and defendant manufacturer where there was no privity of contract between them. Lord Atkin outlined the tension between a strict formal legal code and the need to find justice between the parties. He said: the liability for negligence whether you style it such or treat is as in other systems as a species of "culpa", is no doubt based upon a general public sentiment of moral wrongdoing for which the offender must pay. But acts or omissions which any moral code would censure cannot in a practical world be treated so as to give a right to every person injured by them to demand relief. In this way rules of law arise which limit the range of complainants and the extent of their remedy. The rule that you are to love your neighbor becomes in law, you must not injure your neighbor...Who, in law is my neighbor? The answer seems to be persons who are so closely and directly affected by my act that I ought reasonably to have them in contemplation...I do not think so ill of our jurisprudence as to suppose that its principles are so remote from the ordinary needs of civilized society and the ordinary claims it makes upon its members as to deny a legal remedy where there is so obviously a social wrong." The case was decided in favor of the plaintiff in the absence of privity of contract contrary to the common law rule as set out in Tweddle and Atkinson (1861) but in agreement with a biblical, religious, i.e. moral principle. The Judge was able to exercise discretion, exercise the "autonomy of his subjective will" as Weber put it, to reach a decision which was contrary to certain principles of established law reverting to religious and moral precepts when he thought it was necessary. Formal- rational law is guided by general rules so that the most general, unambiguous, characteristics of cases are taken into account. The highest form of this second type of law is what Weber called logically formal law where only, ...the legally relevant characteristics of the facts are disclosed through the logical analysis of meaning and accordingly, definitely fixed legal concepts in the form of highly abstract rules are formulated and applied ( Weber 1978: 657; 1954; 63)-See Roger Cottereg(1992). This last theoretical definition is tangibly represented by statute and legislation. In addition, Weber says it is this last legal-type which best lends itself to the Benthamite vision of systematization. But between 1800 and 1960, the English legal landscape represented a sort of flexible and floating balance between judicial discretion and inflexible, 2 fixed legal rules s embodied in statute. Even when statutes were enacted on matters such as crime for example, they were loosely worded. S.20 of the OAPA (Offences against the Persons Act)1861 says; Whosoever shall unlawfully and maliciously wound or inflict any grievous bodily harm upon any other person, either with or without any weapon or instrument shall be guilty of an offence triable either way and being convicted thereof shall be liable to imprisonment. Just to note the extent to which the English Legal System is beginning to move away from substantive rational forms of law towards formal-rational law, The case of R v Turner 03-28-2000 C of A, the Times Law Reports demonstrates this. The court was constrained to offend its sense of Justice and uphold a life sentence for a conviction under s.18 of the OAPA 1861 in view of a previous conviction for manslaughter and s.2 of the Crime ( Sentences) Act 1997. S.2 of the 1997 act takes away a judges discretion in sentencing. As Justice Rougier the Judge was compelled to impose a Life Sentence regardless of what he felt was just, this was seen as a remarkable state of affairs although Parliament must have realized this. However, it took Judges, through case law, to clarify the meaning of the statute (OAPA 1861) and the meaning of certain words. Due to uncertainty over the meaning of the word "maliciously", Judges made clear that it meant Recklessness. Later, the meaning of "recklessness" had to be defined in the case of R v. Cunningham (1957) where it was held to mean whether the defendant, in the circumstances, forsaw some risk of harm but carried on in his course of action. It was a subjective test. But later, what the defendant needed to foresee was clarified in the cases of R. v Savage and Parmenter [1991] where it was held that she did not have to foresee the risk of causing the harm prohibited by the statute or the actual harm caused to the victim but merely some risk of harm. The concepts were flexible and open to interpretation. They were not the fixed legal concepts of which Weber spoke although they were embodied in statute. Although a strong belief in the use of statutory rules and the supremacy of parliament had become deeply rooted in the English legal and political tradition, legal rules in legislation or the common law were, to a great degree, substantive, lacking the fixed legal concept required by Weber's strong formal (logical) rational law. This was contrary to the Weberian and Benthamite theories of a technical, gapless, and systematized legal system. But, the theoretical belief in a legal system with these characteristics remained strong as seen in the work of Austin and Dicey. History was on the side of the Bureaucratic system of law. Gad and Asher Horowitz comment that wars "tend to strengthen the bureaucratic/military apparatus of the state, putting a strange twist on Hegel's point that "War is the (civic) Health of the state" ( Horowitz and Horowitz, 1988, p. 79). But, two world wars aided in establishing a number of government ministries which were non-existent prior to the wars and which remained after the end of the conflicts. It led to the development of not only a bureaucratic- military apparatus but a bureaucratic/legal and a bureaucratic/economic apparatus as well. Habermas spoke of the separation of the spheres of money and power from life world via the law. Economics and money was color blind to achieve efficiency. This was the message of the wars if people did not hear it in the law. The intention of the law in the Americas and in Europe as far as universal humanity was confirmed in Somserset vs. Stewart(1772) that demonstrates the freedom of the soul regardless of complexion in lands managed by the English in America and that this law and colorless identification of all men being created equal was embodied in the Declaration of Independence. This is the temperament of that age before and after the Declaration. The institutionalizing efforts so as to take over elements of "Life World" were carried through legislative enactments. Habermas said that it had to be law that institutionalized the independence of economy, state and other domains of action such as education, "sheering" them off from "Life World". An example of this is the Education Act 1944 which systematized and centralized the administration of Education in England. Habermas called this juridification where claims of individual or Human rights are raised to protect against the abuse of authoritative state power. But, they can only do this when the legal system allows such claims. Individual Rights are an expression of the "autonomy of the subjective will". It is only when the system acknowledges this autonomy and premises part of its legitimacy on its protection that citizens can seek to claim individual rights. This is also good for the state. Otherwise, when the political system falls out of line with society where there is no way of appealing to the state for redress through rights claims, it leads to the development of angry sentiment in the citizenry since their independence has been denied. It leads to the development of ideology ( Locke's Second Treatise of Government is an example) on how things might be different which may inevitably lead to revolution ( Hague and Harrop, 1987). It is an old story now( this does not appear in the original version and is a new insight) but Locke also did not acknowledge original sin when discussing human nature and how the original sin took man out of his natural state into the fallen state of war or fallen nature( Hobbes describes this war-nature as an existence where the ego of every man in his self-idolatry separate from and unsubmitted to God outside of the Garden of Eden resisteth the power of other men's egos as in Cain and Abel). The reason why God gave us natural law as embodied in the ten commandments is so that there would be sufficient peace, settlement and commodious living so that men could turn their minds to defying the natural laws of gravity and build an airplane. The citizenry accepts the legitimacy of legal domination because it allows for the instrumental use of the system to fulfill the purposive actions of the subjective will formally and argumentatively redeemed within the legal system. Here one can understand what Habermas meant when he said that the "modern legal order can draw its legitimacy only from the idea of self-determination since the post-traditional morality, post 1960's, supplies a substitute for the natural law that is grounded in religion and metaphysics (Habermas, 1996). The substitute is essentially natural law as found in the workings of society itself and basic human needs that are based on various basic moral values that safeguard and buttress society and that are synonymous with the very religious values that reflect them. Albeit, it is an imperfect world but parents and their children would prefer protection from ice cream with lead in it. So, Here, one also sees the fulfillment of law's self-justifying characteristics. By virtue of its instrumentality, citizens are able to understand themselves as authors of the law to which they are subject as addressees (Habermas, 1996). Law has changed more since 1970 as well since rape was recognized evidently as the sphere of female/feminine authority or the female mind in various sociological studies. The word "female" leaves a great deal of room for definitional import in this discussion but the point is that it is amorphous and other than the purposeful maternal or paternal being. They are not only controlled by the legal bars of the iron cage, the system allows them to discuss, on some level, the extent of control as well as the need for the protection of their autonomy under the resources of the state. Here is Habermas' discursively achieved agreement between state and citizen. Laws or changes within them are the fulfilment of the discursively achieved agreements. It is the rule of the absolute Monarch in natural law and its legitimacy that the people should have the peace of the Magna Carta and this entails the work to hunt down those officials and citizens who resist the simple peace it offers in preserving the meaningfulness of human life. This is the purpose of all State law and action. The is the authority. This is the legitimacy. These individuals and officials challenge authority and peace and are efficiently neutralized by the Monarch and Queen. Every "rights" claim is answered through the instrumental use of law. People are claiming rights more today than they were pre-1960. Because of this law has changed more, becoming more instrumental post 1960. Some Examples of this in the U.K include the Race Relations Act 1976 as well as the Sex Discrimination Act 1975 and the Equal Pay Act 1970. Other examples include the Slaughter of Poultry Act, 1967 ( halal meat for Muslims) and the Motor-Cycle Crash Helmets (Religious Exemption) Act, 1976 ( for Sikhs). The ECHR becomes law in the U.K. in August 2 . — - - The role of the E.U. in English jurisprudence is evidenced further by the ECJ being an additional tier in the English Appellate Court system that will still include, by necessity, the House Of Lords in the format of the Supreme Court Of The United Kingdom. However, the UK courts do not have to follow every determination of the EU courts on the grounds that the position of the ECJ or ECHR are incompatible with UK legislation. If there is a determination or declaration of incompatibility, the EU law will be applied in a manner that is compatible with governing UK law until the UK legislation can be amended to satisfy EU treaty requirements to ensure there is no undue incompatibility affecting the lives of all EU citizens that will include all individuals born or domiciled in the U.K. as EU citizens. R. v. Horcastle & Ors.. confirms this position in the EU. This includes the UK evidently. Without a doubt, there is no loss of legal tradition but a harmonizing in the respect for law as an expression of culture, localized traditions and expectations. EU membership does not prevent this respect of culture. But, we must be careful with efforts at Revisionist history that may sow false notions of both culture and history in the minds and souls of the current impressionable, gullible swivel group in the population who do not work very hard also known as the general tv viewing audience. Our analysis continues but before any further insights from learned writers, let us reflect on a warning provided by some other thinkers. Menski has highlighted these warnings in his recent work: But do lawyers care to read Habermas? Do they appreciate that Critical Theory is more than a cleverly worded, often shallow critique of legal failures to achieve standards of justice, increasingly measured today against certain presumed and asserted international criteria? Are we aware that Jacques Derrida famously called justice something that is always in the making, literally à venir? Earlier wise warning voices, for example Rudolph Stammler in the nineteenth century and Eugen Ehrlich (1913; 1936) at the start of the twentieth century, were drowned out by the remarkable shift away from natural law towards Weberian rationality, privileging various forms of state-centric legal positivism. This has been leading to rather self-serving claims of state law to be ›the law‹, which have only more recently been challenged by the new fashion of international human rights law. The misguided presumption that more recent concepts have simply replaced older forms of law appear to follow evolutionist thinking in the style of Sir Henry Maine. Positive law and now international human rights law as virtual cuckoos in the nest of comparative law, however, spell deep trouble for a more pluralist understanding of law as culture. It is not possible to assume that lessons from the Holocaust have been fully learnt if we continue to hear new horror stories of ethnic cleansing and elimination of all sorts of ›others‹ from various parts of the globe. Humanity as a whole seems to have learnt remarkably little. Or should we admit crucial disconnections between self-congratulatory sophistication of legal scholarship and continuing cruel realities of ›living law‹? Over time, legal scholarship may have become more sophisticated, but in the process the fashionable focus on only one type of law as the dominant law and the efforts to silence all the other types (for those, as we shall see, have not gone away) have clearly had pernicious consequences: Legat From Plural Worlds of Law and The Search For Living Law; Dr. Werner Menski. One can pursue purposive rational 6 action but what is "rational" is objectively ( sometimes subjectively ) determined by the state's legal machinery. From the above discussion, it is evident that, in comparison to the period between 1800 and 1960 law has changed more in the post-1960 era. In the preceding period ( 1800-1960), the theoretical ground work for law's instrumentality, its ability for self-justification, and its capacity for domination was laid. To some extent, Law had already begun to take on these characteristics as society moved slowly away from "traditional domination" toward "legal domination".
